Welcome to Keseffy. These Terms of Use ("Terms") govern your use of our personal financial management system based on Artificial Intelligence and WhatsApp, operated by Hub Global Solutions LLC ("Company", "we", "us", or "our"), a limited liability company incorporated in Wyoming, United States.

By accessing or using Keseffy ("Service"), you agree to be bound by these Terms. If you do not agree with any part of these terms, you must not use the Service.

1. Description of Service

Keseffy is a personal financial management tool that utilizes Artificial Intelligence (AI) to process text messages, audio, and images sent via WhatsApp, organizing this information into financial records.

1.1. Third-Party Dependency The Service depends on the availability and functionality of WhatsApp (Meta Platforms, Inc.). We have no control over WhatsApp and are not responsible for interruptions, blocks, or failures resulting from the third-party platform.

2. Important Disclaimer PLEASE READ CAREFULLY:

2.1. We Are Not Financial Advisors Keseffy is strictly a technological tool for data organization. Hub Global Solutions LLC is not a bank, financial planner, investment advisor, or legal consultant. The Service does not provide financial, tax, or legal advice.

2.2. Accuracy of Artificial Intelligence The Service uses AI models to interpret your data. While we strive for accuracy, AI can make errors (hallucinations), misinterpret values, or miscategorize expenses. It is your sole responsibility to review and verify all transactions recorded by the system. We are not liable for any financial losses or decisions made based on inaccurate data provided by the AI.

3. Eligibility and Registration

To use Keseffy, you must be at least 18 years of age and have full legal capacity to enter into binding contracts. You are responsible for maintaining the security of your device and your WhatsApp account. Any activity performed through your WhatsApp number in our system will be considered your responsibility.

4. Subscriptions, Payments, and Cancellation

4.1. Payments If the Service is offered via a paid subscription, you agree to pay the applicable fees as described at the time of purchase. Payments are processed in U.S. Dollars (USD) unless expressly stated otherwise.

4.2. Brazilian Users and Currency Exchange For users in Brazil, charges may be subject to exchange rates, IOF (Tax on Financial Operations), and other local taxes on international transactions, which are the sole responsibility of the user.

4.3. Cancellation You may cancel your subscription at any time by sending a message to support or through the control panel. Cancellation will stop automatic renewal, but there will be no pro-rated refunds for the period already paid, except as required by law.

5. Acceptable Use

You agree not to use the Service to:

Record or process transactions related to illegal activities (e.g., money laundering, trafficking, fraud).

Attempt to reverse engineer our system or our AI.

Send offensive, violent content, or content that violates the rights of third parties to our WhatsApp bot.

6. Intellectual Property

The Keseffy software, including its AI algorithms, design, logos, and code, is the exclusive property of Hub Global Solutions LLC. Use of the system does not grant you ownership of any intellectual property rights over the Service. The financial data entered by you ("Your Data") remains your property.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW (WYOMING LAWS): IN NO EVENT SHALL HUB GLOBAL SOLUTIONS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE LAST 12 (TWELVE) MONTHS OR USD 100.00 (ONE HUNDRED U.S. DOLLARS), WHICHEVER IS GREATER.

8. Indemnification

You agree to defend, indemnify, and hold harmless Hub Global Solutions LLC from and against any claims, damages, obligations, losses, liabilities, and expenses arising from: (i) your use and access to the Service; (ii) your violation of any term of these Terms.

9. International Users

9.1. Data Transfer By using Keseffy from Brazil or any other region outside the U.S., you acknowledge and consent that your personal and financial data may be transferred to and processed in the United States, under the jurisdiction of U.S. laws, which may have different data protection standards than your country of origin.

10. Governing Law and Jurisdiction

10.1. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

10.2. Dispute Resolution Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming. You waive any objection to the convenience of such forum.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will attempt to provide at least 30 days' notice before any new terms take effect.
